1. Acceptance of Terms

By accessing our website (https://yoga.co.cr), submitting an inquiry, booking a retreat or day spa experience, or using any of our services, you agree to these Terms of Service. If you do not agree to these terms, please do not use our site or services.

We reserve the right to modify these terms at any time. Changes take effect immediately upon posting. Continued use of our services constitutes acceptance of the revised terms.

2. Services Description

Yoga Ashram Costa Rica provides the following wellness services:

• Retreats: Multi-night wellness retreats (4-7 nights) in categories including Reset, Healing, Transformation, and Adventure & Nature.
• Day Spa: Individual treatments, curated packages, and group wellness experiences without overnight accommodation.
• Daily Classes: Yoga, meditation, and movement classes held at our Guanacaste sanctuary, scheduled independently through book.hari-om.co.
• Teacher Trainings: Yoga Alliance registered teacher trainings (200h, 300h) offered through Hari OM School of Yoga and Ayurveda.

All services are subject to availability and require advance booking unless explicitly stated otherwise.

3. Booking and Reservations

• Inquiries: Submitting an inquiry through our website does not guarantee availability. All bookings are confirmed only after we respond with availability, you accept the quote, and payment is received.
• Payment: A deposit or full payment is required to secure your reservation, depending on the service. Payments are processed securely through Stripe.
• Custom requests: Custom retreats, group bookings, and private sessions require explicit written confirmation and may have different terms.
• Age requirement: Guests must be at least 18 years old to book a retreat. Minors may attend day spa services or family group bookings only when accompanied by a legal guardian.

4. Cancellation and Refund Policy

We understand that plans change. Our cancellation policy is as follows:

• 30+ days before arrival: Full refund minus a 5% processing fee.
• 14-29 days before arrival: 50% refund of the total retreat cost.
• Less than 14 days before arrival: No refund. However, you may reschedule your retreat to a later date within 12 months, subject to availability and a $150 rescheduling fee.
• No-shows: Guests who do not arrive and do not provide advance notice forfeit the full retreat cost.
• Day spa cancellations: Cancellations made 48+ hours before the appointment receive a full refund. Cancellations within 48 hours receive a 50% refund. No-shows forfeit the full amount.
• Force majeure: In the event of natural disasters, pandemic-related travel bans, or other extraordinary circumstances beyond our control, we will offer rescheduling or credit at our discretion.

5. Guest Conduct and Sanctuary Agreements

Yoga Ashram maintains specific policies to ensure a safe, respectful, and transformative container for all guests:

• No-intoxication policy: Alcohol, recreational drugs, and hallucinogenic substances are strictly prohibited on the property and during all retreat activities. This policy exists to protect the integrity of the healing container and the safety of all guests.
• Respectful conduct: Guests agree to treat staff, practitioners, fellow guests, and the property with respect. Harassment, violence, or disruptive behavior will result in immediate removal without refund.
• Yoga participation: All physical practices (yoga, breathwork, surf) are invitational and adapted to individual capacity. Guests participate at their own risk and are responsible for communicating any physical limitations or medical conditions.
• Quiet hours: Respect quiet hours from 9:00 PM to 7:00 AM to support rest and restoration for all guests.
• Property care: Guests are responsible for any damage caused by negligence or misconduct.

6. Health and Medical Disclaimer

Our retreats and wellness services are holistic wellness experiences, not medical treatment. We do not diagnose, treat, or cure medical conditions. Our services are designed to support overall well-being through yoga, Ayurveda, meditation, sound healing, and nature immersion.

If you have a medical condition, are pregnant, or are under medical care, please consult your physician before booking. You must inform us of any health conditions, allergies, or physical limitations during registration so we can adapt practices appropriately.

Guests participate in all physical activities at their own risk. Yoga Ashram and its staff are not liable for injuries resulting from guest participation, except in cases of gross negligence.

7. Pricing and Payment

• All prices are listed in United States Dollars (USD) unless otherwise stated.
• Prices include accommodation, meals, and core retreat experiences as described on each retreat page. Flights, airport transfers, travel insurance, and optional add-ons are not included unless explicitly stated.
• Payment is accepted via Stripe (credit/debit card) or cash on arrival for day spa services.
• We reserve the right to adjust prices for future retreats. Confirmed bookings are locked at the quoted price.

8. Intellectual Property

All content on this website — including text, images, videos, logos, and design — is the property of Yoga Ashram Costa Rica or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works without our written permission.

Guest photos or testimonials shared on our website or social media are used with explicit consent. If you wish to remove your testimonial or image, contact us at info@yoga.co.cr.

9. Limitation of Liability

To the maximum extent permitted by law, Yoga Ashram Costa Rica, its founders, staff, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website.

Our total liability for any claim related to our services is limited to the amount you paid for the specific service giving rise to the claim.

We are not responsible for delays, cancellations, or changes caused by events outside our reasonable control, including but not limited to natural disasters, government restrictions, pandemics, or supplier failures.

10. Governing Law

These Terms of Service are governed by the laws of Costa Rica. Any disputes arising from these terms or your use of our services will be resolved in the courts of Guanacaste, Costa Rica.
